NBI News Bulletin: January to October 2023

1. On January 7, 2023, NBI-Puerto Princesa District Office (PUERDO) operatives in coordination with other law enforcement agencies, arrested XXXX in XXXX, Puerto Princesa City.

The case stemmed from a complaint filed against the Subject for secretly recording their intimate moment while on a video call and forcing the Complainant to have sex with the Subject.  Sex videos and nude screenshots  were used to threaten, intimidate, and as a means to facilitate his desire to have sex with the Complainant against her will.

The subject again threatened to expose the sex videos and nude screenshots of the Complainant if she refused to have sex with him.  The complainant finally reported her ordeal to NBI-PUERDO.  Thus, an entrapment operation was conducted that resulted in the Subject’s arrest.

The subject was referred for inquest proceedings to the City Prosecutor’s Office, Puerto Princesa City, Palawan with the recommendation that the Subject be charged and prosecuted for violation of RA 9262 (Anti Violence Against Women and Children Law), violation of RA 9995 (Anti-Photo and Video Voyeurism Act), and Grave Coercion.

 

2. On January 12, 2023, operatives of the NBI-Anti-Human Trafficking Division (NBI-AHTRAD) arrested XXXX due to Child Abuse as defined and penalized under RA 7610 (Special Protection of Children Against Abuse, Exploitation and Discrimination Act). The case stemmed from a letter from Social Services Development of Quezon City requesting assistance and immediate intervention in the case of a minor victim. Based on the letter, the minor is a victim of child abuse committed by her father. In an interview, the victim stated that she was suffering from sexual abuse and being threatened continuously by her father. On the above-stated date, NBI operatives arrested XXXX in a hot pursuit operation.

 

3. On March 10, 2023, operatives of NBI-Anti-Organized and Transnational Crime Division (NBI-AOTCD) arrested XXXX for Grave Coercion in relation to RA 10175 (Cybercrime Prevention Act of 2012) and violation of RA 9262 (Anti-Violence Against Women and Their Children Act). The subject  was arrested in an operation that stemmed from the complaint of his victim who stated that XXXX demanded sexual favors and waiver of his indebtedness in exchange for the deletion and non-dissemination of the complainant’s nude photos in his possession. When Subject instructed the complainant to proceed to a hotel in XXXX, Quezon City on March 10, 2023, for the fulfillment of his demand for sex, NBI-AOTCD operatives hatched an entrapment operation. Operatives rushed to apprehend the Subject when the Subject brought the complainant to a room in the hotel. The subject  was seen naked while the Complainant was crying. The subject was then placed under arrest and apprised of his constitutional rights. Seized from the Subject were his smartphone and driver’s license for identification. Subject XXXX was presented for inquest proceedings before the City Prosecutor’s Office, Quezon City for the above-stated crimes.

4. On March 24, 2023, operatives of the NBI-Environmental Crime Division (NBI-ENCD) arrested XXXX by virtue of a Warrant of Arrest for violation of RA 9995 and RA 9262. Subject was illusive of justice but continued cyber patrolling however point out that Subject was staying at XXXX, Manila. Operatives then proceeded to the said area and successfully arrested the Subject. He was brought to the NBI Detention Center, Taft Avenue, Manila for temporary detention.

 

5. On June 20, 2023, operatives of NBI-Anti-Fraud Division (NBI-AFD) arrested XXXX in XXXX, Marikina City for Robbery/Extortion and violations of RA 9262 (Anti-Violence Against Women and their Children Act), RA 10175 (Cybercrime Prevention Act), and RA 9995 (Anti Photo and Video Voyeurism Act). The case stemmed from the complaint of the Subject’s victim. The complainant  and the Subject were in a relationship that started in 2018. After some time, she found out that Subject was already married. After the Complainant broke up with the Subject, the former received messages through a social media platform. The messages consisted of screenshots of her conversations with Subject, including their intimate video. The sender demanded from the Complainant Php200,000.00 in exchange for the sex video and threatened her that her sex videos would be sent to all of her family, friends, and churchmates. The complainant realized that the video was taken during her intimate encounters with Subject, which the latter recorded without her permission.

6. On September 19, 2023, NBI-Anti-Organized and Transnational Crime Division (NBI-AOTCD) arrested XXXX in Quezon City for violation of R.A. 9262 (Anti-Violence Against Women and Their Children Act of 2004) and Robbery (Extortion).

7. On September 21, operatives of NBI-Anti-Organized and Transnational Crime Division (NBI-AOTCD) arrested XXXX for Rape, Grave Threats in relation to RA 10175, and violations of RA 9262, RA 10591, BP 881, and RA 9165. The case stemmed from the complaint filed by the Subject’s ex-girlfriend. According to the Complainant, Subject went to her house and beat her up until she lost consciousness. When she woke up, Subject was already raping her. Thereafter, the Subject left. The Complainant immediately informed her relatives of the incident. Then they went to the NBI to file a complaint and to seek assistance to apprehend the Subject. The Victim was then accompanied to the NBI-Medico Legal Division (NBI-MLD) for the conduct of medico-genital and physical examinations. The results returned positive for abrasions on the Victim’s genital part and multiple contusions on the different parts of her body. CT scan results revealed that the Victim suffered multiple head trauma. Based on the foregoing, AOTCD operatives conducted a hot pursuit operation against Subject which resulted in his arrest at XXXX, Manila. The operatives were able to seize drug paraphernalia inside the hotel room. Further, a drug test conducted on the Subject revealed that he was positive for use of shabu.

8. The National Bureau of Investigation – Anti-Violence Against Women and Children Division (NBI-AVAWCD) arrested an individual for Consented Abduction under Article 343 of the Revised Penal Code (RPC), violation of R.A. 11930 Section 4(m), and violation of Section 10(b) of R.A. 7610.

Based on the investigation of the NBI-Anti-Violence Against Women and Children Division, it was revealed through Instagram that the Subject indeed manipulated the minor Victim into sending nude pictures and having sexual intercourse by gaining her trust through giving of gifts and such other predatory acts. On September 26, 2023, the Subject went to the school of the minor Victim and gave her birth control pills to prevent her from getting impregnated in preparation for their subsequent sexual intercourse on September 30, 2023. The operatives discovered that the Subject booked a room in San Juan for the purpose of having sexual intercourse with the Victim.

On September 30, 2023, NBI-AVAWCD operatives proceeded to the meeting place of the Subject and the Victim in a mall in Quezon City. The operatives discretely followed the Subject and the Victim until they were about to board a taxi that was hailed by the Subject. It was at this instance that the operatives approached the Subject and announced his arrest.

9. On October 8, 2023, NBI-Anti-Organized and Transnational Crime Division (NBI-AOTCD) arrested XXXX in Las Piñas City for Grave Coercion (Sextortion) under Article 282 of the RPC; violation of R.A. 9262 (Anti-Violence Against Women and Their Children Act of 2004); all in relation to R.A. 10175 (Cybercrime Prevention Act of 2012); and Rape by Sexual Assault under Article 266-A(2) of the RPC, as amended.
